Why Was My Social Security Disability Claim Denied?
Social Security disability claims are denied for a variety of reasons. It’s important to remember that a denial does not mean that you are not disabled or even that you are not qualified for Social Security Disability Insurance benefits. In fact, the Social Security Administration denies claims for all sorts of reasons; some statistics show that as many as 67% of first-time claims are denied. The first step in the appeals process, reconsiderations, are denied at an even higher rate of 87%.
But why does the Social Security Administration deny claims so often? If you look at your notice of denial, you should see the reason why your claim was denied listed.
Some common reasons the Social Security Administration denies SSD claims include asserting that:
- Your injuries do not meet the standard impairment ratings
- You are still able to work, either in your prior employment or a different form of employment
- You have not earned enough work credits
- You have not paid Social Security taxes
Your notice of denial may or may not include a technical rationale outlining the full, detailed reason why your claim was denied. If your notice of denial does not have a technical rationale, request one. This allows you to view the full reason, as stated by the Social Security Administration, as to why your claim was denied.
What to Do If Your SSD Claim Was Denied
It can be disheartening to receive a notice of denial after submitting your Social Security Disability Insurance application. However, it’s important that you know that a denial of your claim is not only not the end of the road, it’s almost expected, given the high rate at which SSDI claims are denied. You still have options if your claim was denied.
After receiving a notice of denial, it’s important that you do the following:
- Request an appeal right away. There is a 60-day deadline to request your appeal, so do not wait. You can request the appeal by contacting the Social Security office.
- Determine why your claim was denied. As previously mentioned, the reason for the denial will be listed on your notice of denial.
- Contact a Social Security disability attorney. Appealing your denied claim is not easy; having an attorney on your side can make a huge difference in the outcome of your case.
What NOT to do after your claim is denied:
- Do NOT fail to appeal the denial of your claim
- Do NOT miss the deadline (60 days) to request an appeal
- Do NOT file a new claim
