Appealing SSD Claims on the Federal Level

If your Social Security Disability (SSD) application has been denied through the administrative appeals process, you may file an appeal with a federal district court. At this stage, a federal judge will review your case to determine if mistakes were made in the previous rulings.

At this stage in the SSD process, it is important to have an attorney on your side. The court will not appoint one for you. The lawyers at the law firm of Coats & Todd have extensive experience handling federal court appeals for clients throughout Texas and nationwide. We are prepared to help you achieve success for your SSD appeal.

Federal Court SSD Appeals

In a federal district court appeal, we are essentially filing a lawsuit against the Social Security Administration. By this point, you have been denied in your initial application, request for reconsideration, administrative law judge hearing and Appeals Council. In most cases, the federal district court appeal is the final chance to secure SSD benefits.

If your claim was denied by the Appeals Council, you have 60 days to file an appeal with the federal district court.

At the federal court level, we must demonstrate that the Social Security Administration's decision was not supported by substantial evidence. In order to do so, it is important that an attorney be well versed in the procedures, pleading guidelines and legal standards that apply in federal court.

We are admitted to practice in all federal district courts in Texas. Our lawyers have extensive experience handling SSD claims from the initial application to the highest level of federal appeal. We routinely handle cases involving hard-to-prove claims such as mental illness, back injuries and chronic pain disorders.
